✕ TERMS OF SERVICE

If caught breaking my TOS, you will be warned or blacklisted depending on the severity.⟡GENERAL･I will decline your commission request if I don't feel comfortable or competent fulfilling your request.･You will be informed of any setbacks that may happen in the process.･Commission will only start after full payment is received.･Please be as specific as possible and provide proper references, keep in mind that I'm not designing your character.･I own all rights over the completed work, which allows me to redistribute (watermarked pieces) for self-promotion. However, if you ask to withhold from posting, I will gladly oblige!•Do not edit / sell / profit / claim the finished commission. FOR ILLUSTRATIONS You are allowed to use illustrations to make physical items for PERSONAL USE ONLY. If you are interested in using my illustrations for commercial use, please let me know and we can discuss!⟡PAYMENTS / REFUNDS•Via PAYPAL or KO-FI only. Must be paid upfront.•Refunds are only accepted if I haven't started the sketch yet. After a commission's sketch has been approved by the commissioner, it is no longer refundable.•I shall send an invoice for every payment.•If you do not pay the invoice within 24 hours, I will assume you do not want to commission anymore and cancel it.⟡USE:•You are free to repost the commission to your account but you have to post it WITH CREDIT, lease only upload either the watermarked version I provided or your own watermarked version.•Personal use ONLY. Don't use my work for any commercial purpose unless discussed to use as commercial.•If you're posting to Toyhouse, please credit kremtaro@toyhouse.•Please do NOT edit, trace, modify or alter the piece in any way.•Please inform me before hand if you choose to commercialize your commission works afterward.⟡COMMERCIAL PRICINGCommercial means usage on streams, broadcast content, or any monetized work (i.e. including but not exclusive to: merchandise, monetized videos, music releases); and reselling rights means selling the Work to another party or another platform or on any platform. Commercial use will include extra charges, please expect the cost to double or triple (~200-300%) from the original price.•Light commercial pricing will be 1.5 to 2x the price of personal commissions, it includes the right for clients to use the artwork for indirect promotional purpose such as: streaming overlays, panels, schedules, websites icon, stream avatars etc. Reproducing and selling the artwork from this tier is prohibited.•Full commercial commissions will be at least 2x the price of personal commissions (such as to be used for merchandise). Pricing will depend on the complexity of the commission timing, and the scale of usage.⟡REVISIONS•Unlimited revisions in the sketch phase: you can ask me to change everything from pose to the whole drawing.•Base colors will be sent with the sketch. (optional)•Minor edits are allowed during line-art.•Major and additional revisions will incur additional fees,⟡TIME:•I usually take about 1- 3 months, maybe way less, but please don't rush me!•Please notify me beforehand if you need the commission done within a specific time or date. (includes an extra fee, [+80%] )Time also depends on the difficulty of the commission. You'll be notified if there are unexpected circumstances!⟡INTELLECTUAL PROPERTY RIGHTS:I, the artist, retain full and exclusive rights to the original artwork, including:• Claiming the commissioned piece as their own work for portfolio purposes and any secondary creation rights.
• Displaying the commissioned work in portfolios, websites, social media platforms, etc.Commissions done for personal, are non-promotional use only,
Clients and other parties may not:
• Claim the commissioned piece as their own work.
• Use the artwork for commercial, direct or indirect profit-gaining purpose.
• Reproduce the artwork for merchandise such as prints, charms, etc.
• Use the artwork for promotion of goods, services, or social media pages, which includes using the art for streaming assets, vtuber schedules etc.
• Use the artwork for any sort of block-chain related technology, such as NFT or AI learning.However, the clients may:
• Repost the artwork online as long as proper credit is given.
•Print the artwork for personal enjoyment/usage.

✕ Extra Charges for every commission type:
⟡Complex designs and additional props such as weapons, plushies, wings, are subjected to extra charges.⟡Extra Character: +100% base price for second character, +50% base price each after two characters.
⟡Urgency / Deadline: 80% base price
⟡Backgrounds: Simple backgrounds like flat colors, gradients or simple patterns are for free.
